Market access and national treatment are two of the key clauses in GATS,which are related to the market open- ness in service trade of GATS members.However,there are many conflicts between market access and national treatment clauses;also among these two clauses and other clauses in GATS.By analyzing the relationship between market access and national treatment,as well as the relationship with other terms,this paper aims to pursue the idea of balance in these con- flicts,in order to maximize the benefits of GATS members and also to achieve the service trade liberalization.

In view of the mandatory application of the principles and application of a combination of encouragement, in law the policy level, should establish uniform technical standards, build a unified market access products for civilian rule, and attempted to introduce the policy of insurance as market risk transfer mechanisms.
